ASCS Cloud (AS Computer Solutions d/b/a ASCS Cloud) — Last Updated: August 2026

These Terms of Service ("Terms", "Agreement") are entered into by and between AS Computer Solutions, operating as and doing business as ASCS Cloud ("ASCS Cloud," "we," "us," or "our"), and you ("Customer," "you," or "your"). These Terms govern your access to and use of the cloud infrastructure, virtual private servers, managed services, and related products and support services (collectively, the "Services") provided by ASCS Cloud at cloud.ascsonoway.com.

Section 1 — Entity & Services Definition

AS Computer Solutions d/b/a ASCS Cloud is the legal entity providing the Services. The Services are owned and operated by AS Computer Solutions, a business organized and existing under the laws of Alberta, Canada, doing business as ASCS Cloud. ASCS Cloud provides cloud infrastructure and hosting services, including but not limited to virtual private servers ("VPS"), managed WordPress hosting, cloud storage, game server hosting, colocation, and related compute, storage, and networking resources (the "Services").

The Services are provisioned on hardware owned, operated, or leased by AS Computer Solutions and made available to Customers on a subscription or pay-as-you-go basis. All Services are provided and governed by AS Computer Solutions, and your use of the Services constitutes acceptance of these Terms. The Services are provided from our infrastructure located in Onoway, Alberta, Canada, and are intended for lawful business and technical use only.

Section 2 — Limitation of Liability

2.1 Fee Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ASCS CLOUD'S (OR AS COMPUTER SOLUTIONS') TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, WHETHER ARISING OUT OF OR RELATED TO CONTRACT, TORT (INCLUDING NEGLIGENCE), NEGLIGENCE, BREACH OF STATUTORY DUTY, OR OTHERWISE, EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) CAD OR (B) THE AMOUNT YOU PAID TO ASCS CLOUD FOR THE SERVICES IN THE THREE (3) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

2.2 Exclusion of Consequential Damages

IN NO EVENT SHALL ASCS CLOUD, AS COMPUTER SOLUTIONS, THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR BUSINESS INTERRUPTION, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ASCS CLOUD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, COST OF SUBSTITUTE GOODS OR SERVICES, AND ANY COMPUTER FAILURE OR THEFT OF DATA.

Section 3 — Data Integrity, Backups, & Uptime

3.1 Customer Responsibility for Data

You are solely responsible for the accuracy, completeness, and integrity of any data, content, or configuration that you deploy, upload, or store on the Services ("Customer Data"). ASCS Cloud is not responsible for any loss, corruption, or unauthorized access to Customer Data. We strongly recommend that you maintain independent backups of all Customer Data outside of the Services.

3.2 Backups

While ASCS Cloud may, in some service tiers, create or retain periodic snapshots or backups of virtual instances, these are provided on a best-effort basis and are not guaranteed to be available, complete, or retrievable. Backups are not included with every service and are not a substitute for your own data protection measures. ASCS Cloud shall not be liable for any failure or delay in creating, retaining, or restoring any backup.

3.3 Uptime

ASCS Cloud does not guarantee that the Services will be uninterrupted, secure, or error-free. The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, ASCS Cloud disclaims all warranties, express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. ASCS Cloud reserves the right to perform scheduled or emergency maintenance, suspend, or modify the Services at any time without liability.
